does not indicate that a contract exists between us. We will indicate
acceptance of your order, and hence a contract between us, when we send you an
invoice. We have included this term to protect us in the case that a mistake
has been made in pricing, we have inadvertently under-priced goods, or we are
no longer able to supply a particular product for some reason. In the case of a
change of price, we will always contact you first to ensure that the price is
acceptable. In case the product is no longer available, we will contact you to
offer the next best alternative.

The sales contract: We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.
Payment: Notwithstanding delivery goods shall remain the property of Physiomart Trading Pvt Ltd until such time as all payments are made in full.
Your rights to cancel your contract: You may cancel your order for the goods at any time up to the end of the seventh working day from the date you receive the ordered goods. You do not need to give us any reason for cancelling your sales contract nor will you have to pay any penalty.
- To cancel your order you must notify us in writing.
- If you have received the goods before you cancel your order then you must send the goods back to our contact address at your own cost and risk. If you cancel your order but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.
- Once you have notified us that you are cancelling your order, any sum debited to us from your credit/debit card will be re-credited to your account as soon as possible and in any event within 30 days of your order provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you. The goods should be returned insured via registered delivery to us undamaged and returned in a saleable condition, the goods must not have been fitted, installed or used in any way, all accompany products ordered with the product must be returned at the same time. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
- All packaging must be retained. Carriers have a right to refuse collection of consignments without appropriate packaging.
Cancellation by us: We reserve the right to cancel the contract between us if:
- We have insufficient stock to deliver the goods you have ordered;
- We do not deliver to your area; or
- One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
- If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for any inconveniences suffered.
Select Delivery Service Required
All online orders are processed within 48 hours from the time of receipt of the order. In case of non-stock or pre-order items, we will let you know the best possible delivery time by email or phone and get your confirmation before processing the order.
Delivery terms on all online orders are ExWorks Physiomart warehouse, Chennai. We generally ship your orders by India post using Business Parcel Service (surface) or Express Parcel Service (Air). Standard delivery times for Business parcel Service are 5-7 working days and Express delivery is received in 4-5 working days depending on your location.
Shipping charges are automatically calculated in the checkout page once you enter the delivery information and mode of shipment preferred and it is calculated based on the weight and dimensions of the products and delivery location. Kindly note that a 14.5% service tax is applicable to your shipping charges.
We are unable to ship to overseas addresses at the moment.
If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing of the problem within 7 working days of the delivery of the goods in question.
If you do not receive goods ordered within 7 days after the delivery due date, we shall have no liability to you unless you notify us in writing of the problem within 30 days of the date on which you ordered the goods.
If you notify a problem to us under this condition, our only obligation will be, at your option:
- to make good any shortage or non-delivery;
- to replace or repair any goods that are damaged or defective; or
- to refund to you the amount paid by you for the goods in question in whatever manner is appropriate
Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) however arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
All orders will be processed the same day and are normally despatched within 48 hours (working days only). All standard delivery are despatched through India Post Business Parcel Service and are normally received in 2-7 days depending on your location. Express orders dispatched by India Post Express Parcel Service are delivered in 2-5 working days depending on your location. Your ordered items must be signed for, or instructions left to ensure the parcel can be left safe. We make every attempt to ensure delivery is made within the promised time.
**Please note - if the post man attempts to make a delivery, and no one is in to sign for the parcel, or you have not left clear instructions for the item to be left safe, no refund will be issued as India Post has made every attempt to deliver the parcel**
Please note that the majority of our orders are dispatched on a 'registered post'. Please ensure when placing your order, that you give an address where someone will be able to take charge of the item, or you can alternatively leave a message in the 'special instructions' section stating that you would like the item to be handed over to a family member, friend or co-worker.
You must inform us within 7 working days of the delivery due date if the goods are lost or damaged in transit so that we can make a prompt claim against India Post and correct the problem. Please quote your order number in all correspondence.
You agree that proof of delivery supplied by India Post is sufficient evidence to establish that goods have been received.
Delivery of goods to you
We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. Before delivery, we will contact you regarding when we will be delivering and whether we would like assistance to aid the driver to unload. Deliveries will be made via India Post. You will be requested to sign for the goods received. Please be aware that we cannot accept any claim for damages caused by the carrier once you have signed for the goods "received in good condition" or words to this effect that appears on the carrier's paperwork/delivery notes.
For your own good please ensure that you check the goods thoroughly for any visible signs of damage before signing.
You will become the owner of the goods you have ordered when they have been delivered to you and paid for in full. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction. If however you delay in accepting the goods, our delivery responsibility for everything other than any damage incurred in transit or other negligence on our behalf will end on the date the carrier tried to deliver the goods to you. The carrier is entitled to hold the goods in storage and charge you a reasonable charge for the storage and insurance for the goods which you will be liable to pay to the carrier. You may also become liable for the redelivery costs of the goods for a second time. Once the delivery process begins, i.e. goods are in transit, then you will not be able to cancel any contract you have with us for the services carried out by us on your behalf such as the postage and packing services.
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
All products on our website are available for purchase and are currently held in stock (unless otherwise stated). In case of non-stock items, we will create a back order and inform you on the best possible delivery time for that specific item. In the unlikely event that our stock is incorrect and we cannot fulfil your order – you will be notified and a credit will be issued for that item.
For orders made from the states and union territories of India, VAT at the then current rate will be added.

We guarantee your satisfaction. Please advise us within 7 days if you are not completely satisfied or the items have been damaged before returning any item. All items returned will be at the customers cost.
Governing Law: The contract between us shall be governed by and interpreted in accordance with Indian IT Act and we both agree to submit to the non-exclusive jurisdiction of the Indian Courts.
Physiomart Trading Pvt Ltd does not disclose buyers' information to third parties other than when order details are processed as part of the order delivery fulfilment purposes. In this case, the third party will not disclose any of the details to any other third party.

All products will be refunded in full provided that they are returned to us unopened and in a re-saleable condition.
Items returned within the 7-day cooling off period:
Where you are withdrawing from your purchase within the seven working day cooling-off period, and there has been no error on our part, we will refund the cost of the item and the cost of sending the item to you. All items must be returned to us using your own courier/registered postal service. We will not refund your costs in returning the item to us.
Items returned under the 30-day returns guarantee:
Where you are withdrawing from your purchase between the seven and 30 days after delivery, and there has been no error on our part, we will refund only the cost of the item in its original packing. We will not refund the cost of delivery service provided to you in connection with your purchase. All items must be returned in saleable condition to us using your own courier/registered postal service.
To ensure the quickest way for your return to be processed is to obtain a Returns Authentication Number (RAN). This is obtained by contacting us by email at email@example.com or calling us on 044 2621 3621. We would require your invoice number (can be found on the invoice sent with your order) and your order number (for online orders) to issue a Returns Authentication Number (RAN). Returns must be clearly marked with the RAN (if obtained), your full name, address, and invoice number. This will enable us to identify the goods.
Once you have been allocated a Returns Authentication Number - simply follow the instructions on the returns form that has been supplied with your delivery.
You can expect a refund in the same form of payment of payment originally used for purchase within 3 weeks of our receiving your return.
Exchanging an Item:
If you have ordered an item incorrectly, then the item can only be exchanged providing the item is being exchanged for the same item but in a different size and is the same value. Items being exchanged must be returned in its original packaging and in a re-saleable condition. Once we have received the item, we will then exchange it for you. Unfortunately we cannot send any exchange item out until the original item has been returned to us. All items must be returned to us using your own courier/postal service. We recommend that you use a 'courier' or 'registered post' service to ensure that you can track the parcel.
Please note that if you wish to return a purchased item - then it must be returned to us in its original packaging and in a re-saleable condition.
All products that are returned to us in an unopened and re-saleable condition will be refunded in full.
